Terms of Use

1. About the service

LuxuryRestocks is operated by TDM Technologies BV, Amsterdam, Netherlands. The service monitors publicly accessible Hermès online store pages and sends notifications to subscribers when products appear to become available.

LuxuryRestocks is not affiliated with, endorsed by, or connected to Hermès International in any way. Hermès® is a registered trademark of Hermès International S.A. All product names, imagery, and trademarks remain the property of their respective owners.

2. No guarantees on alerts

Our alerts are best-effort. We make no guarantee that:

• Every restock will be detected — Hermès may change their website structure, and there may be gaps in coverage.
• Alerts will arrive within a specific time — network delays, third-party delivery issues, or service maintenance may cause delays.
• Products will still be available when you act on an alert — popular items sell out quickly and we have no influence over Hermès inventory.

A missed alert or a delayed notification is not grounds for a refund beyond the cancellation terms described below.

3. Subscriptions and billing

• Subscriptions are billed monthly via Stripe. Your card is charged on the same date each month.
• You may cancel at any time from your dashboard. Cancellation takes effect at the end of the current billing period — you keep access until then.
• Cancel anytime, no commitment. No refunds for partial billing periods.
• Prices are in EUR and include applicable VAT where required.
• We reserve the right to change pricing with 30 days' notice to existing subscribers.

4. Referral and affiliate programme

• Commissions are earned on active referred subscribers and paid monthly.
• Self-referrals, fake accounts, and abuse of the referral system result in immediate forfeiture of all unpaid commissions and account termination.
• We reserve the right to modify commission rates with 30 days' notice. Your locked-in rate at signup is honoured for the life of the subscription.
• Commissions are forfeited if the referred subscriber cancels or charges back their subscription.

5. Acceptable use

• One account per person. Creating multiple accounts to circumvent plan limits or trial periods is prohibited.
• Automated scraping of the LuxuryRestocks dashboard or API without explicit written permission is prohibited.
• You may not resell, sublicense, or redistribute alert data to third parties.
• You may not use the service for any unlawful purpose.

Violation of acceptable use terms may result in immediate account termination without refund.

6. Intellectual property

The LuxuryRestocks name, logo, software, and content are owned by TDM Technologies BV. You may not copy, modify, or distribute them without written permission.

Hermès® is a registered trademark of Hermès International S.A. All references to Hermès products on this platform are for identification purposes only.

7. Limitation of liability

To the fullest extent permitted by Dutch law, TDM Technologies BV is not liable for:

• Missed restocks or failed alert deliveries
• Purchasing decisions made based on our alerts — buying luxury goods is your decision and your financial risk
• Any indirect, incidental, or consequential damages arising from use of the service
• Temporary unavailability of the service due to maintenance, infrastructure issues, or third-party outages

Our total liability to you in any circumstance is limited to the amount you paid us in the 3 months preceding the claim.

8. Termination

We may suspend or terminate your account if you violate these terms, engage in abuse, or if we discontinue the service. In the case of service discontinuation, we will provide at least 30 days' notice and a pro-rata refund of unused subscription time.

9. Governing law

These terms are governed by the laws of the Netherlands. Any disputes will be subject to the exclusive jurisdiction of the courts of Amsterdam.

10. Changes to these terms

We may update these terms from time to time. Material changes will be communicated by email at least 14 days before taking effect. Continued use of the service after that date constitutes acceptance.
